On what grounds are residence permits issued

tartózkodási engedély is a document that allows a foreigner to stay legally in Hungary for longer than an ordinary visa or visa-free regime permits. Each card is issued on a specific legal ground, and it is this ground that determines the package of documents, the validity period of the card and the obligations of the holder during legal residence.

Hungary's migration legislation has undergone significant updates in recent years, and the categories of grounds and the procedures for their registration are regularly reviewed. Therefore, the following discusses mechanisms that work stably, not specific timeframes or amounts — these should be checked directly before submission. A general overview of work directions in the country is provided on the Hungary page.

The most common grounds on which Ukrainians and other foreigners apply:

Mixing grounds or attempting to compile a "universal" package of documents without reference to a specific purpose of residence is one of the most common reasons for delays and refusals. More details on migration registration options in Hungary are provided in the migration to Hungary section.

Legal advice. Before submitting, clearly identify one ground for which you are collecting documents, even if formally there are several options — for example, both work and vendégmunkás status. An unclear package of documents is perceived by the Országos Idegenrendészeti Főigazgatóság as an insufficiently substantiated request, not as an advantage of the applicant.

Where to submit an application

The authority that issues and extends residence permits in Hungary is the Országos Idegenrendészeti Főigazgatóság (National Immigration Authority, OIF), which operates through regional branches throughout the country. The first submission of documents for a long-stay visa for further residence processing usually takes place at a Hungarian consulate abroad — at the location of the applicant's permanent residence.

After entry, the applicant contacts the territorial OIF office serving the place of actual residence to submit an application for the permit card itself. For some categories — in particular the vendégmunkás status — the initial submission can take place without a separate long-stay visa, depending on the applicant's country of origin.

Appointment booking

Most OIF branches and consular offices operate by appointment. Waiting time for an available date varies between Budapest and regional centers: the capital usually has a longer queue. Set aside time not only for collecting documents, but also for the appointment itself, especially if the expiration date of your current visa is approaching. The address of actual residence stated in the application must match the OIF office to which documents are submitted — submissions "not at the place" are most often returned for revision.

What documents to prepare

The exact list depends on the grounds for residence, but there is a basic set that OIF requires in almost every case:

Apostille and hiteles fordítás

Documents issued outside Hungary — certificate of good conduct, birth or marriage certificates for family reunification — generally require apostille in the country of issue and hiteles fordítás: an official certified translation into Hungarian performed by an authorized body. A simple translation without official certification is generally not accepted by OIF offices.

Legal advice. Do not submit documents "just in case" without verifying whether hiteles fordítás is required or a regular certified translation is sufficient. Incorrectly certified translation or missing apostille is one of the most common technical reasons why a package is returned for revision, and the review period actually starts anew.

Biometrics, fees and decision timeframes

After submitting a complete package of documents, the applicant is usually invited to provide biometric data — photography and fingerprints for the production of the permit card. Missing a biometric appointment without good reason can delay case review by weeks.

Fees and review timeframes

Submitting an application and issuing a card involve payment of an administrative fee, the amount of which depends on the grounds for residence and whether it is a first application or renewal. Since legislation is regularly clarified, the specific amount should be verified directly before submission, not based on amounts from previous years.

The law sets an indicative review period, but the actual time depends on the workload of the office, the completeness of the package and the need for additional checks. Delays occur, especially in Budapest during peak periods, and do not in themselves constitute grounds for refusal — but mean that you should actively clarify the status of the case, rather than passively wait for a letter. While the application is under review and the previous visa expires, a foreigner is usually issued with proof of application submission, which certifies the lawfulness of residence at that time.

Legal advice. At Dorosh & Partners, a client tells a lawyer their situation in plain language — what documents are already available, why they need a permit now, what they've already tried to do on their own. The lawyer translates this situation into legal language for an advocate, formulates the grounds for residence, checks the completeness of the package before submission and directs the advocate to exactly where the client really needs help — monitoring the case progress, instead of the client trying to figure out which OIF office and which procedure is right for their situation.

Residence permit card (tartózkodási engedély)

A positive decision means the issuance of a card — a physical document of tartózkodási engedély, which confirms the right to residence for an established period and is simultaneously the primary identification document for a foreigner in Hungary. Time passes between the decision and the actual receipt of the card, required for its production.

The card contains the holder's personal data, photograph, grounds and validity period of the permit. Separately, after registration of actual address, a foreigner receives a lakcímkártya — an address card, which should be updated after each move and is often required together with tartózkodási engedély at government agencies, banks or employers.

Validity period

The validity period is tied to the grounds: for employment it corresponds to the duration of the employment contract within limits, for vendégmunkás status — to the conditions of the specific program, for education — to the duration of the academic year, for family reunification — to the permit period of the person to whom reunification occurs. The expiration date is indicated on the card itself — this is the main reference point for the holder of the permit.

Obligations after obtaining the permit

Obtaining a card is not the end of interaction with the OIF, but the beginning of a period during which the holder of the permit is obligated to keep their data current. The most important obligations:

Ignoring these obligations does not automatically cancel the permit, but creates a discrepancy between the data in the OIF database and the actual situation of the foreigner, which usually emerges at the moment of permit renewal or verification.

Permit renewal

An application for renewal should be submitted in advance, before the expiration of the validity period of the current card — the specific minimum submission period is established by legislation and requires verification at the time of submission, as the rules have been clarified. Late submission creates a risk of a gap in legal status: the period between the expiration of the old permit and the submission of a new application may become a period without valid legal proof of residence. The package of documents for renewal generally repeats the logic of the initial submission: confirmation that the grounds are still relevant, plus valid residence, means of subsistence and health insurance for the new period. A general overview of legalization procedures is provided on the Dorosh & Partners migration services page.

Legal advice. Add the permit expiration date to your calendar immediately after receiving the card and plan the renewal application several weeks before this date, rather than the formal minimum established by law. This time reserve covers possible delays with appointment booking or a missing document that is suddenly needed.

Refusal and how to appeal

Refusal to issue or renew a permit is not uncommon, and it is most often related not to hidden reasons, but to specific, mostly technical or evidentiary gaps in the package. The most common grounds for refusal:

Appeals procedure

The OIF formalizes the refusal decision in writing, setting out the grounds. It can be appealed first through administrative procedures — to a higher authority within the OIF structure, and if necessary — through the courts. The time limit for filing a complaint is limited and runs from the date of receipt of the decision, so you should not delay analyzing the grounds. Appeals are effective when the grounds can be closed with specific evidence: providing a missing document, clarifying the amount of means of subsistence, correcting a translation error or adding an apostille. If the grounds concern the substance itself, more serious work with evidence of the reality of the relationship is needed, not just resubmission of the same package.

Legal advice. Upon receiving a refusal, do not immediately submit a new application with the same set of documents "just in case" — this often leads to repeated refusal for the same reason. First, analyze the written basis separately, prepare exactly what was lacking, and only then resubmit or appeal.

This is where the difference between self-help and lawyer-advocate pair support is most clearly visible. A client brings a lawyer a letter of refusal, the lawyer translates the wording into a clear legal basis for appeal and directs the advocate to prepare exactly the appeal that corresponds to the reason for refusal. If the situation is complex, the easiest way to start is with a consultation.

Frequently asked questions

How long does it take to obtain a residence permit in Hungary?

The timeframe depends on the grounds for residence, the completeness of the package of documents and the workload of the OIF office. The law sets indicative review periods, but in practice time can be longer, especially in Budapest or with additional checks. An accurate forecast should be clarified taking into account the specific grounds and place of submission.

Can I change employers while holding a valid tartózkodási engedély?

Yes, but you must notify the OIF of the change of employer, and in many cases — reregister the permit under a new ground, since the specific employment contract may have been the basis for its issuance. Ignoring this obligation creates a risk during permit renewal.

How does vendégmunkás status differ from a regular work permit?

The vendégmunkás status is a separate, usually simplified procedure for foreigners who arrive to work on a specific employer's invitation or through an authorized agency, often for a fixed term and in a specific sector. The conditions of this status are regularly reviewed, so details should be verified before submission, not based on old information.

What if the card's validity period expires but renewal documents are not yet ready?

An application for renewal must be submitted in advance, before the permit expires — the exact minimum submission period should be clarified before submission. If time is running short, you should seek legal help as soon as possible to assess whether you can meet the deadline.

Is a separate lakcímkártya needed if you already have tartózkodási engedély?

Yes. Tartózkodási engedély confirms the grounds and duration of legal residence itself, while lakcímkártya fixes a specific registered address and requires updating after a move. Both documents are usually required together at banks, with employers or at government agencies.

Obtaining a residence permit in Hungary is a procedure in which every detail matters: the right grounds are chosen, a complete package of documents with apostille and hiteles fordítás, timely attendance at biometrics and equally timely renewal. Most refusals occur not because of complex legal disputes, but because of gaps that could have been closed in advance — especially since the rules are regularly clarified. Support that combines analyzing the situation with a lawyer and practical work with an advocate most often saves not years of legal proceedings, but months that would otherwise be spent correcting one error in a document package.
