Who Still Qualifies for Temporary Protection
Temporary protection in Italy operates under an EU Council implementing decision, which is periodically extended, and an Italian decreto that incorporates this decision into national law. Each extension comes with its own decreto and explanatory circolari from the Ministero dell'Interno. The end date of protection and the renewal windows are not fixed: they change with every new decision, and any article becomes outdated faster than the procedure itself.
The status is retained by Ukrainian citizens and their family members who left due to war and were in Italy before the effective date of the decreto, as well as stateless persons or third-country nationals who held valid protection or permanent residence in Ukraine under this decision at the time they left. Children born in Italy to families with this status are usually included under one parent's protection — this should be checked separately, as the child's inclusion is not automatic.
Key rule. Do not rely on an expiry date you heard a year ago: check the current circolare before each step or contact us — we monitor updates.
If a person entered after the decreto's cutoff date or first obtained protection in another EU country before moving to Italy, the situation requires separate review: rules on "secondary movement" are clarified in the decreto and are not the same for all arrival waves.
Registration and Extension of Status at the Questura
Initial registration and each renewal of the permesso di soggiorno per protezione temporanea is handled by the questura at your place of residence. The standard package includes your identity document, proof of previous residence in Ukraine on the decreto's date, passport-sized photographs, the completed kit for the permesso (a yellow envelope from the post office), and a receipt for the required administrative stamp. The cost of the stamp and associated fees are set by separate regulations that are reviewed periodically — check the amount before submitting rather than relying on figures from the previous cycle.
The renewal window opens a certain time before the current permesso expires — the exact timing is set by that same decreto. Submitting documents too early may result in the questura refusing to accept them, while submitting too late risks a gap in legal residence. We recommend recording the permesso expiry date immediately after receiving it and not waiting for a letter from the questura, which does not always arrive on time.
What Most Often Goes Wrong During Renewal
- An applicant submits an old version of the kit or fills it out with errors, and the questura returns the package for corrections, eating up time before the deadline.
- The address in the application does not match the actual address or the one registered in the anagrafe comune, due to a move that was not reported in time.
- The supporting document has become outdated because the decreto changed between applications and the list of required documents shifted slightly.
The separate question of residenza and iscrizione anagrafica in the comune: official residence registration is not a requirement for protection itself, but it opens access to comune services, simplifies work with the Servizio Sanitario Nazionale, and is needed for some later steps, including transition to another permesso. Register as soon as your address is stable. We covered the renewal process in detail in our article on extending your residence permit — the questura logic for temporary protection largely mirrors the general procedure.
Work Under Temporary Protection
The permesso di soggiorno per protezione temporanea grants you the right to work in Italy for any employer without a separate nulla osta approval, which is normally required for foreign workers admitted under quota. This applies to both employed work and self-employment: a person with temporary protection can open a partita IVA and conduct business as a self-employed person on standard terms.
An employer arranges the employment contract the same way as for any other foreign worker with a valid permesso: they register the hiring with the Ispettorato Nazionale del Lavoro, pay contributions to INPS, and arrange accident insurance with INAIL. The temporary nature of protection does not waive these obligations, and the worker has the right to demand proper documentation from day one.
Legal advice. Before signing an employment contract, verify that your permesso will not expire before the contract term — some employers are reluctant to hire a worker whose permit ends in a few weeks.
Work completed under temporary protection counts toward your employment history, which you will need when transitioning to a work permit. Keep your payslips (buste paga), copies of contracts, and records of paid contributions — they form the foundation for your future transition.
Healthcare: SSN and Medico di Base
People with temporary protection have the right to register with the Servizio Sanitario Nazionale on the same basis as other legally resident foreign nationals. Registration takes place at the local ASL by presenting your valid permesso or a receipt showing a pending renewal application, your codice fiscale, and proof of address. After registration, you receive a health card and are assigned a medico di base, your primary care doctor for routine health matters who can refer you to specialists as needed.
The codice fiscale is a prerequisite for nearly all subsequent steps: without it, you cannot register with the SSN, open a bank account, sign a work contract, or rent a home. It is issued by the Agenzia delle Entrate, and the process for people with temporary protection does not differ fundamentally from that for other foreign nationals, except for the list of supporting documents. The process for registering with the SSN and selecting a medico di base is covered separately in our article on registering with the National Health Service.
- Registration with the SSN covers emergency and routine care on the same basis as Italian citizens in your region.
- You can change your medico di base later if your current doctor is inconvenient in location or language.
- Opening a bank account requires your codice fiscale, identity document, and proof of address — some banks additionally ask for the permesso, others accept a receipt of a pending application.
Kindergarten and School
Children with temporary protection have the right and obligation to attend school in Italy on the same basis as Italian children of the same age — compulsory education applies to them the same way it applies to any foreign minor legally resident in the country. Enrollment takes place through the comune or directly with the school, depending on local practice, and usually does not require proof of Italian language proficiency at the time of application — language support is arranged after enrollment.
Enrollment typically requires your child's identity document, proof of family address, prior school records from Ukraine if available and translated if the school requires it, and age verification. Kindergarten is not compulsory, but it is available on standard terms, including the option to apply for places in municipal or private institutions in your comune.
Legal advice. If school documents from Ukraine are missing, enrollment is still possible based on age and a school interview — do not delay application because of missing papers that can always be submitted later.
Travel to Ukraine and Back
Technically, short trips outside Italy, including to Ukraine, do not automatically strip you of temporary protection. However, prolonged absence or circumstances suggesting actual return to your country of origin on a permanent basis may be grounds for ending your status — each case must be assessed separately, rather than assuming "a short trip is always safe."
Before traveling, ensure that your valid permesso will not expire while you are abroad and that you have time to return and file renewal documents on schedule. If your renewal has already been submitted and you are awaiting the questura's decision, travel during this period requires special care: practice on travel during a pending application review varies across provinces.
Legal advice. Before a trip to Ukraine longer than a few days, verify dates against your valid permesso and check with us whether travel falls during a period when the questura pays close attention to proving continuous residence.
Remember also that if a child travels with one parent or with a third party, border control may request proof of consent from the other parent — this is not specific to temporary protection but a general rule for minors that should be prepared in advance.
Transition to Another Residence Permit
Temporary protection is not a permanent status but a temporary arrangement for the duration of the EU decision. Many people eventually transition to ordinari permessi: a work permit (subordinate or self-employed) based on an employment contract or partita IVA, a family permit through family reunification with a family member who has stable status, or a study permit for those entering an educational program.
Each pathway has its own conditions: transitioning to a work permit usually requires an active employment contract and housing that meets the requirements; family reunification requires proof of family relationship, income, and housing of the sponsor. Transition does not happen automatically when temporary protection ends — initiate it in advance while your current permesso is still valid, to avoid losing legal residence. An overview of all legalization routes in Italy is available on our migration services page.
How Temporary Protection Differs from a Work Permit or Family Permit
The permesso per protezione temporanea is issued on the basis of a collective status established by an EU decision and decreto and does not require individual proof of grounds — it is enough to demonstrate membership in the qualifying category. A work permit or family permit, by contrast, is always tied to an individual basis: a specific employer or family relationship, and renewal depends on whether that basis still exists.
This is why transitioning from temporary protection to a more stable form should be planned well in advance: gather evidence of your work history, verify that your housing meets the requirements for family reunification, and seek advice before your current protection cycle nears its end.
How We Support Temporary Protection Status
Temporary protection looks simple on the surface: the basic entry and residence conditions are indeed broader than for most other permits. But this is precisely where people often lose focus on the details that matter most — renewal timing, deadline coordination, and choosing the right moment to transition to another permit. We handle temporary protection cases at all these stages, and nearly every case shows the same pattern: problems arise not from the procedure itself but from a delayed response to a decreto change or to a change in your own circumstances.
Before filing renewal documents, we review your complete package before you visit the questura: does the address match your anagrafe registration, is the kit form current, do you have all the documents whose requirements may have shifted with the new decreto. An error at this stage means not just another visit but the risk of a gap in legal residence during the questura's review — a gap that later complicates transition to another status.
When you are preparing to transition from temporary protection to a work permit or family reunification, we assess your situation in advance: does your employment contract meet the requirements, do you have enough documented work history, and what housing and income documents will the receiving authority need. This allows you to file a new-permit application before time becomes critical, avoiding a period when your old status is nearly exhausted and the new one is not yet in place.
We also handle the related issues that in practice stop people more than the questura itself: registering residenza with the comune, obtaining your codice fiscale, registering with the National Health Service, enrolling children in school, preparing documents for your bank or employer. Each of these steps seems simple alone, but executed in the right order they save months — whereas missing one step often means returning to the same authority.
If your renewal date is approaching, you are planning travel to Ukraine longer than a few days, or you are thinking about transitioning to another permit, it is worth consulting in advance: we will check what renewal window is open under the current decreto, prepare your document package, and if needed, accompany you to the questura. You can book a consultation through the form on our website, and a self-check guide is available in our extension checklist for temporary protection, which we compiled separately for this procedure.
Frequently Asked Questions
Does temporary protection end on a specific date you can name in advance?
The date is set by an EU decision and corresponding decreto and is reviewed each time the term approaches ending. Base your planning on the current circolare from Ministero dell'Interno at the time of your inquiry, not on a date you heard earlier — it may have already changed.
Can temporary protection be combined with self-employment under partita IVA?
Yes, the permesso per protezione temporanea grants the right to self-employment on the same basis as employed work, and opening a partita IVA follows standard procedures available under this permit type.
What happens if I miss the deadline for filing a renewal application?
The risk is a gap in legal residence between when your old permesso ends and when you file the new application package. Such a gap limits access to services and complicates later transition to another permit, so always file renewal documents within the window set by the current decreto.
Is separate residenza registration required if I already have a residence permit?
A permesso and residenza registration at the comune are two different things. The permesso proves legal residence, while residenza opens access to comune services and is required for certain status transitions, so register as early as possible.
Can I transition directly from temporary protection to citizenship?
No, temporary protection itself does not lead to citizenship. You must first transition to an ordinario residence permit, and only after accumulating the required period of legal residence under the new status can you consider the path to citizenship.
Temporary protection status gives you real and broad rights in Italy, but it depends on procedures that are updated regularly through decrees and circolari — so check the current rules before each important step rather than acting on memory of the previous cycle. Timely verification of dates, careful document management, and early planning of your transition to another permit remain your most reliable tools for maintaining legal residence in Italy.
